1. Acceptance of Responsibility for Uploaded Content
By submitting any video, image, audio, or other form of content (collectively, “Content”) to The
Sharanarthi platform, you (the “User”) explicitly agree that you are solely responsible for all
Content that you create, upload, and share on the platform. You affirm that the Content is either
your original work, or you have obtained all necessary rights, permissions, licenses, and clearances
from any third parties to upload, distribute, and publicly display the Content. You assume full
responsibility for any legal, civil, or criminal consequences arising from the Content you provide,
including its accuracy, legality, appropriateness, and public dissemination.
2. User’s Legal Authority and Warranties
By uploading Content, you expressly represent, warrant, and covenant that:
a) You have the full legal right, authority, and capacity to upload, publish, and share the Content
on The Sharanarthi platform.
b) You own all necessary rights to the Content, including intellectual property rights, or you have
secured the express permission of any individuals, organizations, or entities depicted in the
Content.
c) The Content does not infringe upon the intellectual property rights, privacy rights, publicity
rights, or any other rights of third parties, including but not limited to copyrights, trademarks,
and personal likeness rights.
d) The Content does not violate any applicable laws, rules, or regulations in any jurisdiction,
including but not limited to local, state, national, or international laws regarding defamation,
privacy, data protection, or criminal conduct.
e) The Content has not been manipulated in a way that misrepresents facts or creates a false
narrative.
f) Any person or persons depicted in the Content have provided informed consent, where applicable,
for their image, voice, or personal information to be used and made public.
3.Exclusion of Liability for TheSharanarthi
TheSharanarthi, including its directors, officers, employees, volunteers, affiliates, partners, and
agents (collectively, “The NGO”), does not assume any legal responsibility or liability for the
accuracy, authenticity, legality, or appropriateness of the Content uploaded by Users. The NGO does
not own or endorse any User-Generated Content (UGC) and serves solely as an intermediary platform
facilitating the publication of such Content for public interest and legal purposes. The NGO
explicitly disclaims any and all liability arising from:
a) Defamation, libel, slander, or false statements made in any uploaded Content.
b) Violations of privacy rights, including unauthorized use of an individual’s likeness, voice, or
personal data.
c) Intellectual property infringement, including the unauthorized use of copyrighted material,
trademarks, or patents.
d) Violations of any local, national, or international laws or regulations.
By using TheSharanarthi platform, you acknowledge that the NGO has no obligation to monitor or
control the Content uploaded, nor does it guarantee the accuracy, reliability, or lawfulness of any
Content submitted by Users. The NGO reserves the right to review, remove, or restrict access to any
Content at its sole discretion, but the absence of such action does not indicate acceptance or
validation of the Content's lawfulness.
4. Legal and Regulatory Cooperation
The Content you upload may be used as evidence in legal proceedings and shared with law enforcement
agencies, judicial authorities, human rights organizations, or other authorized entities in
accordance with the laws of India, the United States, or other international jurisdictions. By
uploading Content, you agree that The NGO may cooperate with government bodies, courts, and
international organizations, including but not limited to the United Nations, human rights
tribunals, and regulatory agencies, in sharing and utilizing the Content to pursue justice for
victims of persecution and human rights violations.
5.Indemnification and Hold Harmless
You agree to indemnify, defend, and hold harmless The NGO, its officers, directors, employees,
volunteers, affiliates, and agents from and against any and all claims, demands, liabilities,
losses, damages, costs, and expenses (including reasonable attorney’s fees) arising out of or in
connection with:
a) Your submission, publication, or dissemination of any Content.
b) Any breach of this Disclaimer or violation of applicable law in relation to the Content.
c) Any claim that the Content infringes on the rights of any third party, including intellectual
property rights, privacy rights, or other legal interests.
d) Any harm, damages, or distress caused to any individual or entity by the publication of the
Content on The Sharanarthi platform.
6. No Guarantee of Privacy or Anonymity
The primary purpose of TheSharanarthi platform is to document, share, and use evidence of crimes
against religious minorities to seek justice. By uploading Content, you understand that the
information you provide may be used in public proceedings, courtrooms, or other official processes
and may not remain confidential. The NGO makes no representations or warranties regarding the
privacy, anonymity, or confidentiality of Content once uploaded. Any identifying information
associated with the Content may be disclosed to authorities, human rights bodies, and other legal
entities as part of the pursuit of justice.
7. User Agreement to Public and Legal Use
By uploading Content to TheSharanarthi platform, you irrevocably grant The NGO the right to use,
reproduce, distribute, display, and make the Content available to the public for the purposes of
advancing justice, legal prosecution, and advocacy for persecuted minorities. You acknowledge that
the Content may be shared with third parties, including but not limited to legal professionals,
journalists, activists, and international organizations, without further notice or consent from you.
Once submitted, the Content may be used in ways beyond the control of The NGO, and you agree to
release The NGO from any claims, liabilities, or damages arising from such use.
8. Compliance with International Laws
TheSharanarthi operates globally and adheres to the legal frameworks of multiple jurisdictions,
including but not limited to the laws of the United States, India, the European Union’s General Data
Protection Regulation (GDPR), and international human rights standards. By using The Sharanarthi
platform, you agree to comply with all applicable laws, rules, and regulations of your own
jurisdiction subject to review by legal authorities in different jurisdictions, and you agree to be
bound by any legal or regulatory outcomes stemming from such reviews.
9. Limitation of Liability
In no event shall The NGO be liable for any direct, indirect, incidental, consequential, or punitive
damages arising out of or related to your use of the platform or the submission of any Content. This
limitation applies whether the alleged liability is based on contract, tort, negligence, strict
liability, or any other legal theory, even if The NGO has been advised of the possibility of such
damages. The maximum aggregate liability of The NGO in connection with any claims arising from
Content uploaded to the platform shall not exceed the amount paid by you, if any, to access the
platform.
10. Governing Law and Jurisdiction
This Disclaimer shall be governed by and construed in accordance with the laws of India and, where
applicable, the laws of the United States. Any disputes arising under or in connection with this
Disclaimer shall be subject to the exclusive jurisdiction of the courts located in Pune, India, or
the appropriate courts in the United States, depending on the nature of the dispute.
